Notice: On 24th March 2010 new Commission Regulation (EU) No 271/2010 amending Regulation (EC) No 889/2008, came into force . This act of law lays down detailed rules for the implementation of Council Regulation (EC) No 834/2007, as regards the organic production logo of the European Union.

On 7th August 2009 new regulation on organic farming came into force (Dz.U. nr 116, poz. 975)

Main changes in the act:- an implementation of changes related to EU regulations on organic farming (Council Regulation No. 834/2007 of 28th June 2007 on organic production and labelling of organic products and repealing Regulation (EEC) No. 2092/91),
- an application of enterprises in organic farming or any changes in applications must be submitted to certification bodies only, instead of previously applying not only to the certification body, but also to Voivodship Agricultural and Food Quality Inspection (WIJHARS),
- certification bodies are obliged to publish on their web sites a list of producers under control and quantity of all products,
- a producer applying for authorisation for exceptional rules, i.e. permanent tethering of cattle, purchase of non-organic animals, retrospective recognition of conversion period must apply to Voivodship Agricultural and Food Quality Inspection (WIJHARS). An opinion given by the certification body has to be attached to this application,
- inputs for organic production e.g. fertilizers, plant protection products maybe labelled as 'organic', 'eco' or 'bio' or if they are compliant with aims and rules of organic farming,
- inspectors of organic farming are obliged to pass an exam and to be registered in the Register of Agricultural and Food Quality Inspection untill 31st December 2010,
- financial penalties for certification bodies, i.e. for not submitting a list of producers or a report or not submitting a report on time and also for issuing certificates which do not fulfil requirements,
- financial penalties for operator which place on the market non-compliant or wrongly labelled goods.

Notice: On 1st January 2009 new EU regulations came into force
On 28 th June 2007 the European Council of Agricultural Ministers agreed to a new Council Regulation No. 834/2007 on organic production and labelling of organic products and repealing Regulation (EEC) No. 2092/91. Main changes in the rules of organic production:- Producers of packaged organic food must use the EU organic logo from 1st July 2010. The use of the logo on organic foods from third countries, however, is optional. When the EU organic logo is used, the place of production of the agricultural ingredients must be indicated starting on 1 July 2010.
- Foods may only be marked as "organic" if at least 95% of their agricultural ingredients are organic. Organic ingredients in non-organic food may be listed as organic in the list of ingredients, as long as this food has been produced in accordance with the organic legislation. In order to ensure better transparency, the code number of the control body must be indicated.
- The use of genetically modified organisms (GMO) and of products produced from GMOs is still prohibited in organic production. Products containing GMOs may not be labelled as organic unless the ingredients containing GMOs entered the products unintentionally and the GMO proportion in the product is less than 0.9%.
- The distribution of organic products from third countries is only permitted on the common market, when they are produced and certified under the same or equivalent conditions. The import regime has been expanded with the new legislation. Previously, only organic goods from third countries recognised by the EU or goods whose production was certified by the Member States and which had received an import licence could be imported.
- The list of substances permitted in organic agriculture has not been changed.
- A basis for the acceptance of EU rules on organic aquaculture, seaweeds and yeast is laid in the new legislation.
On 5 September 2008 the European Council of Agricultural Ministers agreed also to Commission Regulation (EC) No. 889/2008 with detailed rules on production, labelling and inspection including its first amendment on production rules for organic yeast. First amending Regulation, establishing new production rules for the production of organic yeast. -
